Confidentiality: 

The user, upon accessing counseling services is entitled to protection of confidential information shared with the therapist. Therapy is a safe space, and the right to confidentiality is an integral part of this safe space. The conversations between a therapist and client constitute privileged information, meaning that the contents of these interactions are not revealed to anybody.

– All therapists at The Happiness Potion are bound by rules of confidentiality.

Limitations to confidentiality include:

a. Information disclosure in cases of imminent danger to self/others: When there is evidence of threat or harm to self or others, therapists are required to disclose such information to the Emergency Contact shared by the client. 

b. Disclosure to nominated representative (if applicable)

c. Disclosure to statutory authorities: In the rare event that a statutory authority like High Court/Supreme Court/ Board or other authorities warrant disclosure of privileged information in order to ascertain the client’s status.

d. Disclosure of information to other healthcare providers like psychiatrists, GPs etc. to inform and facilitate treatment.

e. Disclosure in the interest of public safety and security

Only such information as is relevant for safeguarding life will be shared with legal authorities, if the contingency arises. As far as possible, every attempt will be made to discuss the step of disclosure to the emergency contact with the client beforehand. Our confidentiality policy is in accordance with the Mental Healthcare Act, 2017 and is subject to change to reflect changes in legislation and/or policy.
